In most situations, a probate property is sold. For example, it might be to raise funds to pay for Inheritance Tax and the funeral of the deceased or because the beneficiaries do not have a need for the property. However, with the strength of the property market and in particular rental property, it might be worth looking at renting a probate property.

To rent a probate property, there are a number of aspects to consider, but long-term – especially if you plan to live in the property at a later date but are just not quite ready yet – it could turn out to be a sound financial investment. So, how do you rent probate properties?

First, let’s just consider what a probate property is. Simply put, it is a property that a deceased person owned. It is part of their estate and is therefore subject to the probate process.

An important point to remember is that the beneficiaries of a deceased’s estate are not allowed to finalize anything with that property, such as sell it, rent it out, or live in it, until the executors (or administrator if the deceased didn’t leave a will) have received Grant of Probate. This gives them the authority to manage the property and sign the necessary paperwork to finalize a sale, a rental or to allow the beneficiary to live in the property.
